Terms of Service & Service Agreement

These Terms of Service and Service Agreement ("Terms" or "Agreement") form a binding agreement between Pink Dulce Cleaning ("Pink Dulce," "we," "us," or "our") and you ("you," "the client," or "the customer"). By requesting an estimate, booking an appointment, checking a box agreeing to these Terms, or allowing us to perform service, you accept and agree to be legally bound by all of the Terms below. Please read them carefully. If you do not agree, do not book or accept service.

1. Services

Pink Dulce provides residential and commercial cleaning services, which may include standard cleaning, deep cleaning, move-in/move-out cleaning, office cleaning, and optional add-on tasks selected at booking. The specific tasks performed are based on the service type and the details you provide. We determine, in our reasonable judgment, the methods, products, supplies, and equipment used to perform the service.

Window cleaning. When window cleaning is selected, we clean interior window glass that can be safely reached from the floor or a small step stool. For safety and insurance reasons, we do not clean any window that requires a ladder to reach, exterior or upper-floor windows, or any window we cannot access safely.

Steam mopping & floors. Steam cleaning is offered only on floors rated safe for steam — such as sealed ceramic or porcelain tile, sealed natural stone, and sealed vinyl or linoleum. We do not steam laminate, hardwood, unsealed, waxed, or otherwise heat- or moisture-sensitive floors. When you book a deep clean, you agree to accurately tell us your floor type(s); if a floor's type or condition is unknown or unsuitable for steam, we will clean it by traditional mopping instead. To the fullest extent permitted by law, we are not responsible for damage to floors that were misidentified, undisclosed, unsealed, previously damaged, improperly installed or finished, or not recommended by the manufacturer for steam cleaning.

2. Estimates & Pricing

Prices and quotes provided on our website or during booking are estimates only, based on the information you supply (such as home size, service type, and condition) and on standard expectations for a space of that type. Your final price is confirmed at or after the time of service and may differ if the actual size, condition, level of soiling, clutter, or scope of work differs from what was described. We will communicate a material change before performing significant additional work where reasonably possible. A minimum service charge may apply to every appointment, and recurring-service discounts apply only while service continues on the agreed schedule.

3. Agreement to Pay in Full

By booking, you agree to pay the full amount due for the service in full. Payment is due after the cleaning is complete, by invoice, and is payable upon receipt unless we agree otherwise in writing. We never charge before the job is done.

You agree that you will not withhold, reduce, or offset payment based on satisfaction concerns; your sole remedy for any concern is the re-clean described in Section 8. You authorize us to charge any payment method you place on file for the full invoiced amount. You agree not to initiate a chargeback or payment dispute for properly rendered services. If payment is late, returned, or charged back, you agree to pay a reasonable late/processing fee, interest at the maximum rate allowed by law, and all reasonable costs of collection, including attorneys' fees and court or arbitration costs. We may decline future service while any balance remains unpaid.

4. Scheduling, Cancellations & Rescheduling

Appointment dates and times may change. We will give you at least two (2) hours' notice of any change we make, and we ask the same courtesy from you. Same-day cancellations, lockouts, or our inability to access the property at the scheduled time may result in a cancellation or trip fee. Repeated last-minute cancellations may result in our declining future service.

5. Our Right to Cancel or Stop Service for Cause

We reserve the right to refuse, cancel, pause, reschedule, or stop a cleaning at any time, for cause, in our sole and reasonable discretion. "Cause" includes, without limitation: unsafe, unsanitary, hazardous, or biohazard conditions; pests or infestation; extreme clutter; threatening, harassing, or abusive behavior; intoxication; suspected illegal activity; non-payment of a prior balance; inability to access the property; or any condition that puts our health, safety, property, or equipment at risk. If we cancel or stop service for cause, we are not liable to you for doing so, you remain responsible for any work already performed and any applicable trip or cancellation fee, and we are not obligated to provide a refund.

6. Recurring Service

If you sign up for recurring service (for example, weekly or bi-weekly), the discounted recurring rate applies only while you remain on that schedule. You may pause, change, or cancel recurring service at any time with reasonable advance notice. Skipping or extending the interval between cleans may affect your rate, since more time between visits generally means more work per visit.

7. Access & Preparation

You are responsible for providing safe and reasonable access to the property at the scheduled time, including any entry codes, keys, or instructions, and for ensuring utilities (water, electricity, heat) are available. To help us work efficiently, please pick up clutter and secure or put away items you do not want disturbed. If we cannot access the property or work safely, a trip fee may apply.

8. Satisfaction & Re-Clean (Sole Remedy)

Your satisfaction matters to us. We offer a re-clean of missed areas only when all of the following conditions are met:

  • Notice. You contact us in writing within twenty-four (24) hours of your appointment.
  • Photo proof. Your message includes clear, dated photographs of the specific area(s) you believe were missed.
  • In scope. The area or task was included in the cleaning package you booked. We do not re-clean tasks that were not part of your service, areas that were blocked, occupied, or inaccessible during the original visit, or anything that was cleaned and later re-soiled, used, or disturbed.

If your request meets all of these conditions, we will schedule a return visit to touch up the affected areas within five (5) days, at a time we mutually agree on. A travel fee may apply if your address is more than 30 miles from our service origin.

This re-clean is your sole and exclusive remedy for any service concern. It is limited to the specific verified areas (not a full re-clean of the home), is offered once per appointment, and does not entitle you to any cash refund, price reduction, discount, or withholding of payment. Failing to provide access for the scheduled re-clean forfeits this remedy.

9. Photo & Media Release

You acknowledge and agree that we may take photographs and video of the spaces and areas we clean, including before-and-after images. You grant Pink Dulce an irrevocable, royalty-free, perpetual license to use, reproduce, edit, and publish those images for any lawful business purpose, including social media, advertising, marketing, our website, portfolios, and staff training, without further notice, approval, or compensation to you.

We will not intentionally publish images that show your full street address, faces of occupants, or clearly identifying personal information for marketing purposes. If you do not want photos of your space used publicly, you must tell us in writing before your appointment, and we will limit those images to our internal records.

10. Valuables, Fragile & Irreplaceable Items

Please secure cash, jewelry, firearms, prescription medication, collectibles, and any fragile, sentimental, or irreplaceable items before your appointment. We are not responsible for high-value or one-of-a-kind items that were not put away. By booking, you confirm that any such items have been secured or that you accept the risk of leaving them out.

11. Pets

Please tell us about pets in advance and secure any pet that may be anxious around visitors, equipment, or vacuums. You are responsible for your pets' behavior, and we may pause or reschedule service if a pet makes it unsafe to work.

12. Property Condition, Damage & Breakage

We treat your property with care and carry liability insurance. If you believe we caused damage, you must notify us in writing within twenty-four (24) hours of the appointment so we have a fair opportunity to inspect it; claims made after that window are waived. We are not responsible for: pre-existing damage; normal wear and tear; items that were already broken, worn, loose, or improperly secured, hung, or installed; damage from defects in your property; or damage we could not reasonably have anticipated. Our handling of any approved damage claim is limited as described in Section 14.

13. Disclaimer of Warranties

Our services are provided "as is" and "as available." We use reasonable care and skill, but to the fullest extent permitted by law we disclaim all warranties of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or any guarantee of a specific result, the removal of every stain or mark, or that a space will be free of all dust, allergens, germs, or odors.

14. Limitation of Liability

To the fullest extent permitted by law, our total liability to you for any claim arising out of or relating to our services or these Terms—whether based in contract, warranty, negligence, or any other theory—is limited to the amount you paid for the specific cleaning that gave rise to the claim. To the fullest extent permitted by law, we are not liable for any indirect, incidental, consequential, special, punitive, or exemplary damages, or for lost profits, loss of use, or loss of property value, even if we were advised of the possibility of such damages.

15. Release & Waiver of Claims

To the fullest extent permitted by law, you release, waive, and discharge Pink Dulce Cleaning and its owner, employees, and contractors from any and all claims, demands, damages, and liabilities arising out of or related to our services, except to the extent caused by our gross negligence or willful misconduct. This release does not apply to any liability that cannot be waived under applicable law.

16. Indemnification

You agree to indemnify, defend, and hold harmless Pink Dulce Cleaning and its owner, employees, and contractors from any claims, losses, damages, liabilities, and reasonable costs (including attorneys' fees) arising out of your breach of these Terms, your provision of unsafe or inaccurate information or access, the condition of your property, or the acts of any person or pet at the property.

17. Assumption of Risk

You understand that cleaning involves the use of equipment, water, and cleaning products, and that some risk is inherent in any work performed in your space. By booking, you knowingly and voluntarily accept the ordinary risks associated with the services.

18. Dispute Resolution, Binding Arbitration & Class-Action Waiver

Please contact us first—most issues are resolved quickly and informally. If a dispute cannot be resolved informally, you and Pink Dulce agree that, to the fullest extent permitted by law, any dispute arising out of or relating to these Terms or our services will be resolved by final and binding individual arbitration administered under the rules of a recognized arbitration provider in the county where the service was provided, rather than in court, except that either party may bring an individual claim in small-claims court.

You and Pink Dulce agree that any dispute will be brought only in an individual capacity, and not as a plaintiff or class member in any class, collective, or representative action. You and Pink Dulce waive any right to a jury trial to the fullest extent permitted by law. If any part of this section is found unenforceable, the remainder still applies.

19. Force Majeure

We are not liable for any delay or failure to perform caused by events beyond our reasonable control, including weather, illness, accidents, vehicle breakdown, utility or power failure, natural disaster, or government action.

20. Service Area

We serve locations within approximately sixty (60) miles of Fort Drum, New York, including Fort Drum and Jefferson, St. Lawrence, and Lewis Counties. A travel surcharge may apply to addresses beyond a set distance, and we may decline service outside our area.

21. Changes to These Terms

Our services, pricing, and these Terms are subject to change at any time. The version in effect on the date of your appointment applies to that appointment. Please review this page before booking.

22. Governing Law, Entire Agreement & Severability

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-law rules, and any court proceeding permitted under these Terms will take place in the county where the service was provided. These Terms are the entire agreement between you and Pink Dulce regarding the services and supersede any prior understandings. If any provision is found invalid or unenforceable, the remaining provisions stay in full effect, and the invalid provision will be enforced to the maximum extent permitted by law.
